1. Who we are

Visit the Americas (“the Site”, “we”, “us”, “our”) is a travel discovery and directory

2. The three ways we operate

We run three distinct services, and your legal relationship with us is different for each:

• Affiliate content. Some links on this Site are affiliate links, including
  to booking and experience partners such as Expedia, Viator and Stay22. If you book through one
  of those links, your contract is with that provider, not with us, and we may earn a commission
  at no additional cost to you.
• eSIM data products. eSIM passes are sold by us as digital goods and
  delivered electronically. See section 6.
• Direct listings (stays and tour guides). Property owners and tour guides
  listed in our directories are independent third parties. We are not a party to,
  and take no part in, any agreement, payment or service between you and a listed host or guide.

3. Listings are independent businesses

All negotiation, booking, payment and delivery of a stay, tour or guide service takes place
directly between you and the host or guide, on their own website, checkout page
or messaging channel.

We never take, hold, process or transmit your payment to a host or guide, and we
charge no commission on those transactions. We are paid by hosts and guides for
listing and verification services, not by taking a cut of your booking.

4. What “Verified” means — and what it does not

Some listings carry a “Verified” or “Verified Partner” badge. That badge records what we
observed on a specific date:

• for a stay, the date of a physical walkthrough audit of the property;
• for a guide, the date we checked their credentials against the issuing registry.

It is a point-in-time snapshot, not a continuing guarantee or certification.
In particular:

• We do not warrant that a listing remains accurate after its verification date.
• We do not state or imply that a property is safe, structurally sound,
  secure, or fit for any particular purpose.
• We do not inspect or assess gas, electrical, structural or fire safety.
  Those assessments require a qualified, licensed professional, and you should engage one if you
  need that assurance.
• Amenities, ownership, licensing, pricing and service quality can change without notice.

The badge shows the date it was issued. Please read it as “we looked on this date”, nothing more.

5. Off-platform transactions — indemnity

To the maximum extent permitted by law, you agree to indemnify, defend and hold
harmless Visit the Americas and its owners, officers, employees and contractors from and
against any claim, loss, damage, liability or expense (including reasonable legal fees) arising
out of or related to:

• (a) any stay, tour, service or transaction arranged directly with a listed host or guide;
• (b) any inaccuracy, change or misrepresentation in a listing after its verification date;
• (c) any injury, loss, damage or dispute occurring on or in connection with a third party’s
  property or services.

This does not limit any liability that cannot lawfully be limited. Nothing in
these terms excludes or restricts our liability for death or personal injury caused by our
negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be
excluded or restricted by law.

6. eSIM products

• eSIM passes are digital goods, delivered automatically as a QR code and
  activation details to the email address on your order and shown on your order confirmation page.
• Because delivery is immediate and the product cannot be returned, you lose the
  statutory right to cancel once the eSIM has been supplied to you, provided you gave
  express consent to immediate delivery and acknowledged that you would lose that right. We ask
  for that consent at checkout and record it against your order. If you do not give it, the order
  will not proceed.
• If an eSIM is faulty, does not activate, or is never delivered, you are entitled to a full
  refund. See our Refund and Returns Policy.
• Coverage, speeds and network availability depend on our carrier partners and local
  conditions, and vary by location. Please read the coverage note on the product page before
  ordering.
• You are responsible for confirming that your device supports eSIM, is network-unlocked and
  compatible with the destination network.

7. Prices, payment and tax

Prices are shown in US dollars unless stated otherwise. Payment for eSIM products is taken by
our payment processor; we do not store your full card details. VAT: where we are registered for VAT, our VAT number appears on your invoice.

8. Affiliate links and independence

We earn money in three ways: affiliate commission on links to booking partners, fees paid by
hosts and guides for listing and verification services, and advertising in our editorial
sections.

Affiliate and advertising relationships do not buy editorial coverage,
a verification badge, or a favourable write-up. We do not publish content we know to be false,
and we do not accept payment for a positive review.

9. Informational content

Travel guides, itineraries, visa notes, prices and opening times published on this Site are
general information only and may become out of date. Entry requirements, safety conditions and
prices change without notice. Always confirm with official sources — embassies, immigration
authorities, tourism boards and carriers — before you travel or book.

10. Acceptable use

You agree not to misuse the Site, including by scraping or bulk-extracting content, attempting
to gain unauthorised access, interfering with its operation, or submitting false or misleading
information in an application or order.

11. Limitation of liability

To the maximum extent permitted by law, the Site and its content are provided “as is” and
“as available” without warranties of any kind, whether express or implied. Our total aggregate
liability for any claim relating to the Site will not exceed the greater of (a) the amount you
paid to us in the twelve (12) months preceding the claim, or (b) one hundred US dollars
(US$100).

Nothing in these terms excludes or limits our liability for death or personal injury caused
by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot
be excluded or limited under applicable law. If you are a consumer, your statutory
rights are unaffected by these terms.

12. Changes to these terms

We may update these terms from time to time. The version published on this page, with its
“last updated” date, is the version in force. Continued use of the Site after a change means you
accept the updated terms.

13. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive
jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may
bring proceedings in your local courts, and nothing in this clause affects your right to rely on
the mandatory consumer protections of your country of residence.
